DLP successfully assists North West woman in securing £22,500 compensation following a shocking case of dental negligence.

In 2011, Mrs E from the North West began to suffer from uncomfortable pain in her wisdom tooth, resulting in an extraction at her local dental hospital. After a poor level of care and mistreatment by hospital staff, Mrs E was awarded £22,500 in damages with help from the Dental Law Partnership.

When Mrs E visited the hospital in regards to her aching wisdom tooth, she was under the impression that she would be relieved from pain once the extraction was complete. Unfortunately, this was not the case – during the extraction procedure, Mrs E sustained a dental nerve injury and her tooth was not removed in its entirety.

After the extraction, Mrs E returned stating that she was still experiencing pain where the tooth had been extracted, as well as numbness in the side of her face. Mrs E was told that the nerve was still inflamed which could have been down to food impact and was given a short course of medication to try and help with the pain.

Mrs E continued to suffer with pain at the extraction site and it was after visiting another consultant at the local hospital that it was discovered that there was still part of the root left in the socket. After having to endure extensive spells of pain during her lengthy wait, the root of the tooth was eventually removed under general anaesthetic in 2012. This was an avoidable operation which was caused by the hospital’s poor level of care.

Mrs E told us, “I couldn’t believe I had such a long wait before the problem was rectified, despite it being caused by the hospital themselves.”

Mrs E has had to take medication and suffers from numbness and pain if touched in a certain way on her face. She has experienced regular difficulty when eating and drinking and it has had a huge impact on her personal life and confidence.

Mrs E was so dissatisfied with the way she had been handled by the hospital, she decided to seek advice from the Dental Law Partnership. Our specialist team of solicitors made Mrs E aware that she had suffered from dental negligence and had grounds to make a claim for compensation. We took on her case and she was successfully awarded £22,500 in damages.
