Legal case in relation to Orthodontics – Woman from the North West receives £40,000 after undergoing 2 years of inappropriate orthodontic treatment.
Our client Miss E, a 36 year old woman from the North West, has received £40,000 in an out of court settlement after her dentist carried out two years worth of orthodontic treatment that was unsuitable for the problems that Miss E was suffering from.
Miss E first visited Dr I for orthodontic treatment in 2002, Miss E was concerned about the gaps in her teeth from the earlier loss of two of her pre molars and a recurring click that she had in her jaw. Dr I suggested orthodontic work to move her jaw and implant treatment to fill the gaps. Miss E underwent two years of orthodontic treatment which included having all four wisdom teeth removed, braces, elastic bands and retainers. When Miss E visited a new dentist in 2008, it was discovered that Dr I had in fact created space between the wrong teeth, and had unnecessarily removed all of Miss E’s wisdom teeth when they showed no symptoms, her dentist had also provided orthodontic treatment that was not correct for the minor clicking that Miss E was experiencing in her Jaw.
Due to Dr I’s inappropriate treatment plan Miss E will now have to undergo further remedial orthodontic treatment that includes the provision of 4 implants and crowns.
Dr I did admit liability for a number of breaches of duty however denied that he had advised Miss E that the click in her jaw could be fixed with orthodontic treatment, with the help of the Dental Law Partnership Miss E was successfully able to settle her case. Miss E commented ‘ I am so grateful to now have the money to fix the problems that Dr I caused’.
