Process of making a claim

  • 01

    Your Enquiry

Our relationship with clients usually begins with a telephone call to our freephone number 0800 152 2033, which connects you to one of our new business team.

  • 02

    Our Claim Questionnaire

A member of the new business team will then complete a claim questionnaire over the telephone, which asks you for details of the treatment that you have received.

The claim questionnaire is available on the website and can be submitted online.

  • 03

    Questionnaire Assessment

The questionnaire will be assessed by one of the firm’s directors – three of whom are qualified dentists as well as solicitors.

We will then contact you to let you know whether we can take your case on or whether we may need some further information.

  • 04

No Win – No Fee Agreement

Most of our cases are funded on Law Society approved Conditional Fee Agreements (in other words ‘no win – no fee’ agreements). If your claim is successful, a percentage of your legal costs will be recovered from the dentist’s insurer or defence organisation. If your claim is unsuccessful you will not be charged for our legal costs. You will also not pay us anything as your case progresses.

Once you have signed and returned the funding agreement we will be acting on your behalf and we will deal with the dentist and his/her insurers on your behalf.

  • 05

    Your Legal Representative

If we are able to accept the case then the initial stage of your case will be handled by a member of the disclosure team.

Your member of the disclosure team will be your point of contact throughout the initial part of your claim and will be available to answer all your queries and guide you through the process until the case reaches the clinical assessment stage.

Frequently Asked Questions

  • How long do I have to make a dental negligence claim?

You have three years from the date you were aware of the negligence to make a claim. If you are under the age of 18, you have three years to make the claim from the point you become 18.

The legal process of a dental claim can take time, which is why we always encourage claimants to get in touch as soon as possible.

  • Can I sue my dentist?

Yes, if you have suffered harm or mistreatment as a direct result of your dental care, you have a case. WHO you sue will depend on where the treatment took place.

NHS dental claims are made directly against the treating dentist or practice not the NHS. This means the compensation you receive does not come out of the NHS budget.

Private dental claims are made directly against the dentist and/or their practice.

Think you have a case? Contact us today for a free consultation. Our team will discuss your case with you and determine how much compensation you may be able to receive.

  • How much compensation will I receive?

The amount of compensation you are entitled to will vary from case to case. Speaking to one of our solicitors will enable you to determine how successful you will be and the amount of compensation you could receive.

If you are a victim of dental negligence and have suffered malpractice at the hands of a dental professional, we are ready to fight for you.

  • How to sue a dentist?

The best way to sue a dentist is to contact a specialist law firm like Dental Law - we are experts in this field with a track record of success.

Our solicitors will be able to discuss your experience with you and determine if you have a case or not. We will ask you about the incident in question, the reason behind your complaint, and how severe your injuries are as a result of the negligence.

  • How long does a dental negligence claim take?

The duration of your claim varies from case to case. Some claims may take 18 months to complete while others take longer. If the dental professional takes responsibility for their actions, the case can be wrapped up sooner rather than later. However, if they do not admit liability then cases can take much longer.
