In 2022, we were nominated for and won Outstanding Case of the Year 2022, hosted by The National Personal Injury Awards. The Dental Law Partnership was nominated for this award due to our case, Hughes v Rattan. As well as clarifying the law, this case is also now used as a teaching point within the modern legal sector, showing how ground-breaking our work is.
During the case, the Court of Appeal confirmed that the defendant practice was liable to the claimant on the basis that the practice owed the claimant a non-delegable duty of care. As a patient of the dental practice involved, the claimant was classed as being under the care of that practice, leading to the defendant practice being found liable for the dental negligence suffered by the claimant.
