A woman from the South East has secured a compensation win of £81,500 after the Dental Law Partnership helped her claim against her dentist. After Miss N discovered she had undergone 3 years of unnecessary orthodontic treatment she decided to take action against Dr I.

Between 2009 and 2012, Miss N was advised that she could have fixed braces in order to improve the appearance of her teeth and her overbite. After years of feeling uncomfortable with her smile, she agreed to the procedure in the hope her dentist would amend her teeth. Miss N said, “I’ve always had a pronounced overbite and although my teeth weren’t all over the place, Dr I suggested a simple brace would ensure I would achieve the straight smile I’ve always wanted and fix my overbite.”

Before starting the orthodontic treatment Dr I should have suggested that Miss N improve her oral health before going ahead with braces; Instead Dr I commenced  Miss N’s treatment without any oral health guidance. She had the braces fitted by Dr I and started to see another general dentist who informed Miss N that she had poor oral health, but due to the way the braces had been fitted it made it very difficult for her to brush her teeth properly.

After three years of treatment Miss N’s dentist suggested that she should visit another orthodontist as he wasn’t seeing any improvement in her teeth.  Upon visiting a new orthodontist it was discovered the orthodontic treatment was having no measurable benefits and extensive decay had occurred in the roots of her teeth due to her poor oral health, unfortunately resulting in early chronic gum disease.

Due to Dr I’s incorrect orthodontic treatment Miss N could now potentially lose 12 teeth. Dr I should never have provided this orthodontic treatment as it requires surgical intervention in order to fix Miss N’s overbite.
