Most of the time, your claim will be either accepted or denied based on the initial phone call. However, in some cases, we will need to discuss your case with our in-house legal team first.
  2. Once your claim has been accepted, you will be provided with all the documentation needed to progress with your case. As well as the terms and conditions, you’ll also be given a no-win, no-fee agreement to sign – this ensures you won’t have to pay anything if your claim is unsuccessful.
  3. Next, we’ll pass your details across to our team of paralegals who will go over your case in more depth. We’ll collate your dental records and any evidence of negligence, before establishing a timeline for your claim. Dental records legally have to be kept for a minimum of two years – you can also request a copy if needed. Your case will then be assessed by our in-house dental team, as we’ll need to ensure that it is strong enough to progress further.
  4. Once we’ve worked through the chronology of your case and deemed that you have a strong claim, it will then be assigned to one of our own dental negligence solicitors. Your dental solicitor will draft a letter of claim, which will then be sent to the defendant.
  5. The defendant has four months to respond to the letter of claim. Once we have received a response, your dental negligence solicitor will negotiate with the defendant/their representative to settle your claim.
  6. Most of our dental negligence claims are settled within the negotiation stage. However, the case may have to go to court if we are unable to reach a settlement with the defendant.
