Dental Negligence Solicitors Claims Manchester

Have you suffered from dental negligence in Manchester? If so, you could be eligible to make a compensation claim against your dental practitioner. No amount of compensation will erase the avoidable harm you’ve faced during negligent treatment, but it may help you to move on with your life – particularly if you need to pay for remedial treatment.

If you have been let down by the professional that you trusted to look after your dental health, it can have a significant negative impact on your life. Not only can there be pain or discomfort from a procedure that went wrong, but you might also be left with more dental bills to pay for further treatment, as well as the emotional side of experiencing negligence.

If this negligence has left you with visible dental issues, your confidence and self-esteem may also be affected by what has happened to you, and it might be difficult to see anything positive coming out of what you’ve experienced.

Here at the Dental Law Partnership, we’re an expert team of specialist solicitors, focusing solely on the field of dental negligence. We’re able to provide expert legal advice across the dental field, and our experienced team can help you throughout the entire claims process.

How Can You Make a Dental Negligence Claim in Manchester?

If you’ve faced negligent dental treatment in Manchester, you may be considering making a claim against your dentist. However, you’ll likely want to understand how the dental negligence claims process works before getting started, as this will give you a better idea of what to expect.

Every case we take on is different, so if you do decide to start a compensation claim with the Dental Law Partnership, it may not follow this process exactly. However, this section should give you a general view of our usual procedure, so you can decide whether you’re ready to open a case with us.

Our claim process usually follows these steps:

  1. When you first decide to get in contact with the Dental Law Partnership, a member of our experienced team will speak to you to take down your details. You’ll be asked a series of questions about your experience, to see whether your claim of negligence is something we can accept. Most of the time, your claim will be either accepted or denied based on the initial phone call. However, in some cases, we will need to discuss your case with our in-house legal team first.
  2. Once your claim has been accepted, you will be provided with all the documentation needed to progress with your case. As well as the terms and conditions, you’ll also be given a no-win, no-fee agreement to sign – this ensures you won’t have to pay anything if your claim is unsuccessful.
  3. Next, we’ll pass your details across to our team of paralegals who will go over your case in more depth. We’ll collate your dental records and any evidence of negligence, before establishing a timeline for your claim. Dental records legally have to be kept for a minimum of two years – you can also request a copy if needed. Your case will then be assessed by our in-house dental team, as we’ll need to ensure that it is strong enough to progress further.
  4. Once we’ve worked through the chronology of your case and deemed that you have a strong claim, it will then be assigned to one of our own dental negligence solicitors. Your dental solicitor will draft a letter of claim, which will then be sent to the defendant.
  5. The defendant has four months to respond to the letter of claim. Once we have received a response, your dental negligence solicitor will negotiate with the defendant/their representative to settle your claim.
  6. Most of our dental negligence claims are settled within the negotiation stage. However, the case may have to go to court if we are unable to reach a settlement with the defendant. This can extend the timeline of your claim, but our dental negligence solicitors will do whatever they can to get you the justice you deserve.

In terms of the length of your case, this is not something that we can state for definite, as every situation is different. However, our team of dental negligence solicitors will do whatever they can to resolve your claim as quickly as possible, so you can get the compensation you deserve.

We aim to act as transparently as possible – if you’d like to find out more about how our clinical negligence claims work, please request a callback from our expert team today.

Our Fees Explained

If you’re considering hiring a dental negligence claims solicitor in Manchester, you’ll likely want to learn more about our fees, as well as the dental negligence compensation you could receive if your claim is successful.

As every case is different, it’s not possible to state the exact amount of compensation you could receive. This factor will depend on things like:

  • The form of negligence that occurred
  • Whether the negligence you are suing for took place on one visit or over a period of time
  • How badly the incident has impacted your life, including psychological harm
  • The severity of the negligence and the injury it caused
  • The impact of the negligence on your life, now and in the long term
  • The pain and suffering you have experienced
  • Any loss of earnings you have experienced because of the negligence
  • The cost of further treatment
  • If any extra fees have been incurred – for example, if you had to travel to visit a dental expert as part of your claim

However, in most situations, you’ll usually receive more compensation if the claim is of a serious nature. If you’d like to find out about the amount you could receive if your claim is successful, our Client Stories page may be of use.

In terms of our fees, this is also something we can’t state for definite without knowing the details of your case, as we’ll take a percentage of the compensation received when your claim is won.

You can rest assured that you won’t need to pay anything if your claim is not successful, taking some of the worry away. At the Dental Law Partnership, we work on a solely conditional fee agreement basis – sometimes known as a ‘no-win, no-fee’ agreement.

A no-win, no-fee agreement means that you will only pay our fees if your claim is successful. We believe that legal action should be available to everyone, no matter what their personal circumstances are. If you’re worried about paying for a claim, our conditional fee arrangement means you can access our services without the stress of finding funds to pay our fees.

Will I Have to Go to Court if I Make a Dental Negligence Claim in Manchester?

The vast majority of successful dental negligence claims in Manchester and across the country are settled out of court.

If the dental professional defends the claim, there is a small chance that the claim might need to go to court. If this does happen, the Dental Law Partnership will be with you every step of the way, offering expert advice and specialist support to help your claim achieve the best possible outcome.

If a judge rules on your successful claim, they will also decide on the level of compensation awarded.
