What you can do if you’re unhappy with Dental Treatment

If you have received dental treatment that you’re unhappy with, there are several different options that you might be able to take, depending on the circumstances.

If the dental treatment you received is not satisfactory because you don’t think the treatment worked, you may just want to return to your dentist for them to repair the issue. For example, if you have a filling or crown fitted and it falls out within a few weeks or months, you can usually return to your dentist and they will carry out the procedure again for no charge.

However, if you’re unhappy with dental treatment over a longer period of time, or believe that you have received negligent treatment from your dentist that resulted in pain, distress or further dental problems, you may be able to make a claim for compensation due to dental negligence. How do I report a bad dentist?

There are a few different things that you can do to report a dentist that you think has been negligent with your care.

Unhappy with NHS Dental Treatment

If you’re an NHS dental patient unhappy with the treatment you have received, you may be eligible to make a compensation claim if your dentist was negligent in your care and you have suffered as a result. You can contact the Dental Law Partnership for free initial advice so that we can advise you whether you can make a claim. You can also complain to the dental practice itself, to NHS England or the General Dental Council, but none of these options will give you financial compensation. If you’re in Wales, you can contact the complaints manager at your local health board to make sure that your compliant is logged. If the dental treatment that you are unhappy with was carried out in an NHS hospital, you can complain to the hospital’s patient liaison service.

Unhappy with Private Dental Treatment

If you are unhappy with private dental treatment the procedure for making a dental negligence claim is exactly the same as for NHS treatment. At the Dental Law Partnership, we offer free initial advice so that you can find out if your circumstances make you eligible to make a claim. If you want to also make a formal complaint about private dental treatment you have received which you think wasn’t up to standard, you can contact the Dental Complaints Service (DCS), a service set up specifically for dealing with private dental treatment complaints, but this route will not result in you receiving financial compensation. For complaints serious enough to question the dentist’s fitness to practise, the General Dental Council (GDC) may take up the complaint for you but will not compensate you financially.

Are there warning signs of a bad dentist?

As a patient, you have a right to expect that your dentist, whether NHS or private, is capable of delivering dental treatment of an appropriate standard. Dentists go through many years of training and supervision to ensure that they are properly qualified to practice. Most dentists and other dental professionals consistently deliver a high standard of care to their patients. However, avoidable mistakes do sometimes happen, and dentists can sometimes fail in their duty of care to patients. If this happens to you, and you are injured as a result, or need significant additional treatment to correct the mistake, you may be able to make a compensation claim for dental negligence. Whilst there might be no specific signs of a bad dentist to look out for, you can familiarise yourself with some of the main types of dental negligence. These can include:

  • Dental injuries caused by your dentist whilst treating you
  • Your dentist failing to diagnose a condition or problem, which results in you suffering avoidable pain or further treatment
  • Your dentist failing to properly explain a procedure and getting permission from you before carrying it out i.e. failure to obtain consent
  • Nerve damage caused by dental negligence
