Mr M a man from the south east of England has been awarded £9,000 in compensation with the help of special dental negligence solicitors, the Dental Law Partnership.

Mr M from the south east has been awarded £9,000 in compensation after his dentist Dr H failed to spot and treat tooth decay leading to an unnecessary extraction of one of his teeth and the future loss of another.
In May 2015 Mr M made and appointment to see his dentist after feeling discomfort in his jaw.
X-rays were taken and a new filling was fitted.
His dentist, Dr H, advised our client that everything was fine so Mr M believed that would be the end of it.
But Mr M’s pain only got progressively worse.
“It got to the point where I could not sleep at night due to the pain and throbbing in my jaw, it felt like the pain was surrounding the filling on my tooth and I just knew something wasn’t right.”
Our client went to see Dr H again in 2016, he was told the tooth would need extracting due to the severity of decay that had developed.
“My tooth ended up being extracted that day and I just couldn’t believe it, I was in total shock. I didn’t even know that I had tooth decay, Dr H never told me before”
But Mr M’s problems did not end there.
“The pain in my jaw and the tooth next to the extracted one just continued and it was getting as painful as before, I was struggling to sleep and eat, it was excruciating”
Our client decided to see another dentist this time just 2 weeks after the previous extraction.
Mr M saw a new dentist and he was shocked to find out that his previous dentist had failed to use reasonable care and skill at treating our clients tooth decay which would result in the avoidable future loss of his tooth.
X-rays showed that the tooth decay had spread to the other tooth and it would require root canal treatment and crown provisions to help preserve its life but he would ultimately lose this tooth in the future also.
“It was heart breaking to know that I would ultimately lose my other tooth even after the needed procedures to preserve it. I was told that the extraction of my other tooth could have been avoided if my dentist had treated the tooth decay earlier.”
“You trust your dentist knows what he is doing, I feel like I’ll never trust a dentist again,”
Mr M contracted the Dental Law Partnership. Analysis of his dental records revealed that Dr H had consistently failed to diagnose and treat tooth decay between 2015 and 2016. All this led to the problems Mr M experienced and to him losing his tooth in the future.
Amanda Pietrusiak of the Dental Law Partnership commented: “The distress and pain our client experienced was completely unnecessary. If the dentists had carried out adequate treatment in the first place, all his problems could have been avoided.”
The Dental Law Partnership took on Mr M’s case in 2017. The case was successfully settled in 2020 when the dentist paid £9,000 in an out of court settlement. The dentist did not admit liability.
